Appleby ‘Problem’ Trusts Seminar Attracts Big Turn Out

Trust companies in Jersey can and should focus on a number of key practical steps in dealing with problematic trust issues says trust litigator and Appleby Managing Partner, Michael Cushing.

The trust litigation specialist was speaking at a special Appleby seminar for trust professionals attended by over 100 business people from within Jersey’s trust sector on 12 February.

Michael Cushing said: “The fact that over 100 trust company Directors and their advisers attended this event clearly shows that the trust market in Jersey is tuned into finding practical ways to manage problem issues which arise in relation to trusts.”

“Developing a structure to manage problems proactively is key, as well as understanding how to deal effectively with regulators and insurers.”

Called ‘A Toolbox for Dealing with Problem Trusts’, the leading law firm’s seminar was delivered by Appleby’s specialist trust team which includes Litigation Group Head in Jersey, Fraser Robertson, Michael Cushing and Head of Private Client & Trusts in Jersey, Naomi Rive.

Fraser Robertson added: “Trust companies in Jersey need to be prepared to address all the pitfalls and difficult issues which can often arise during the lifetime of a trust. The Court can assist trustees in many ways in dealing with problem issues which arise and there are some simple steps involving the Court that can be taken to avoid risks and help to resolve many difficult issues. The Appleby Toolbox aims to hand over this experience in a practical way.”
